TERMS AND CONDITIONS OF PARTICIPATION FOR HUDSON VALLEY MAKER FAIRE: It is mutually agreed between the parties, GARNER Arts Center (“GAC”) and [APPLICANT], his/her agents and employees (hereinafter referred to individually and/or collectively as “Maker”), that Maker desires to present an Exhibit, Presentation or Performance at GAC in an event entitled: Hudson Valley Maker Faire (“Festival”) to be held on May 20 & May 21, 2023 at the Garnerville Arts & Industrial Center aka GARNER Historic District of New York (“GHD”), 55 Railroad Avenue, Garnerville, NY 10923 (“Premises”). The parties acknowledge that fair consideration has been received and is acknowledged prior to submission of this online proposal. The Festival will take place on the dates and times hereinafter provided, and upon all terms and conditions herein set forth. Participation: Submission of the application form does not confirm participation in Festival. Makers will be invited to participate in Festival based on the sole discretion of GAC and the Hudson Valley Maker Faire team and will be notified by GAC of its decision to approve or deny any Maker’s application via email. GAC reserves the right to cancel its invitation to any participating Maker at any time for any reason. Health and Safety: GAC requires that all participating Makers agree to observe GAC’s covid safety protocols for public health and social distancing, or such other guidance then-in-effect. Makers are not permitted to use, display, sell or ignite any combustible materials as part of any Exhibit, Presentation or Performance. Requirements: All Exhibit and/or Presentation materials must arrive with Maker and be ready for installation by Maker in Maker’s area/booth as specified by GAC on the agreed upon arrival date and time as specified by GAC. Requirements for Presentation of Artworks: All Artworks must arrive with Maker and be ready for exhibition by Maker in Maker’s area/booth as specified by GAC.* Maker will provide Festival visitors with the following information for all artworks for sale: title, media, dimensions and price. If Maker’s work is not for sale, the work must be clearly labeled as “Not for Sale” (NFS) as part of the information provided to Festival visitors. *This is not applicable to GARNER Historic District artist and artisan open studios. Commercial Makers: Commercial Makers, i.e. Makers who participate for the primary purpose of selling a product or promoting a service and/or business organization, are responsible for their own business setup. GAC requires a fee to sell products or merchandise or to promote one’s business and/or commercial services at Festival as a Commercial Maker. Fee tiers are determined by the type of Commercial Maker, i.e. $75 for Artists/Crafters, $150 for small businesses (1 to 4 employees) and $300 for larger businesses (5 or more employees). Upon notification of acceptance, Maker will have fifteen (15) business days to render payment of the fee to GAC based on the appropriate tier (as determined by GAC) payable to GAC prior to receiving Maker’s space assignment and Festival access materials. Insurance: Maker understands and acknowledges that GAC does not carry art insurance for any public Exhibit and/or Presentation within the Festival. Maker agrees to sign a Hold Harmless Agreement (should Maker's proposal be accepted) on or before arrival for Festival. Shipping: Maker understands and acknowledges that he/she is responsible for BOTH the drop-off and pick-up of Exhibit and/or Presentation. If Maker has not claimed Exhibit and/or Presentation within fifteen (15) days of the Festival, i.e. June 5, 2023, GAC maintains the right to ship Exhibit and/or Presentation materials to the address provided in Maker’s application at Maker’s sole cost and expense. Agreement: The submission of an Exhibit, Presentation or Performance proposal to Hudson Valley Maker Faire shall constitute an agreement on the part of the exhibitor or Maker to the terms and conditions set forth in the online application form and the Participation Form.
